Frequently Asked Questions
Learn more about Attorney feeSaver™ and how it works from frequently asked questions from plaintiff attorneys.
Attorney feeSaver™ is a tax planning program designed for successful plaintiff attorneys who receive large contingent legal fees. It combines two established tax planning strategies for attorneys: attorney fee deferrals and executive benefit planning. The program allows eligible attorneys to defer or eliminate taxes on current fees, grow those funds tax-free, receive flexible tax-free income in the future, and provide a tax-free death benefit for loved ones.
Attorney feeSaver™ helps solve the tax problems that come with high-income years and large contingency fee payouts. A major settlement can push an attorney into higher tax brackets and create a significant immediate tax bill.
Traditional retirement tools like 401(k)s and IRAs often have contribution limits, required minimum distributions, employee participation requirements, and withdrawal restrictions that make them less effective for high-earning attorneys. Attorney feeSaver™ is designed to reduce or potentially eliminate income taxes on qualifying legal fees while creating long-term tax-free income.
Attorney feeSaver™ is generally intended for plaintiff attorneys who meet several key qualifications:
- Annual income: $250,000 or more
- Net worth: $2,500,000 or more (including value of your law firm)
- Equity owner in your law firm (or have your own entity where you can receive legal fees ex: personal LLC)
- Be in relatively good health to qualify for life insurance.
No. You do not necessarily have to be the only owner of the firm. The key requirement is that you are an equity owner in your law firm or have your own entity that can receive legal fees, such as a personal LLC.
In other words, the program is not limited to solo firm owners. What matters is whether your ownership and entity structure allow the plan to be properly implemented.
A 401(k) can still be useful, but it usually does not solve the same problem Attorney feeSaver™ is designed to address. Traditional retirement plans often have contribution limits, employee participation requirements, required minimum distributions, and restrictions on when funds can be accessed. For high-earning attorneys, those limits can make 401(k)s and IRAs less effective for managing large contingency fee years.
Attorney feeSaver™ is designed to help eligible attorneys reduce taxable income on qualifying legal fees to zero or close to zero, with no annual contribution limits, no required minimum distributions, no employee participation requirement, and no need to wait until retirement to access funds.
Paying taxes first reduces the amount of capital available to invest. That means less money working for you from the start, less potential compounding on pre-tax dollars, and potentially less long-term wealth.
Attorney feeSaver™ is designed to help eligible attorneys reposition qualifying legal fees before taxes reduce the investable amount. Instead of paying taxes first and investing the remainder, the program aims to preserve more capital, support tax-free growth, and create future tax-free income.
Attorney feeSaver™ is not a mass-market tax strategy. It is designed for a specific subset of successful attorneys who have large contingent fees, ownership in a firm or fee-receiving entity, and the health profile needed for insurance-based planning. The underlying components have existed for decades, but Attorney feeSaver™ is unique because it combines established attorney fee deferral and executive benefit strategies into one coordinated program.
Yes. Attorney feeSaver™ is built on two long-standing planning concepts, attorney fee deferrals and executive benefit plans, both of which have been used for decades and are well-established.
A tax opinion from a leading tax law firm is available upon request. Because every attorney’s situation is different, those who wish to participate should review the strategy with their own tax, legal, and financial advisors before implementation.
The timing depends on the attorney’s plan design, age, goals, and funding strategy.
As a general guideline, we recommend about 10 years from the start of the Attorney feeSaver™ program before beginning the tax-free income stream. That accumulation period gives the plan time to grow and compound tax-free, which can help create a stronger long-term income stream and death benefit.
Yes. Attorney feeSaver™ can be used alongside a 401(k) or other retirement planning strategies.
A 401(k) may still play an important role in your overall plan, but Attorney feeSaver™ is designed to address tax and wealth-building opportunities that traditional retirement plans often cannot fully solve for high-earning plaintiff attorneys.
There is no separate out-of-pocket cost to set up an Attorney feeSaver™ plan. Eligible attorneys can begin the planning process without paying a separate setup fee directly to Attorney feeSaver™. Any plan-related costs or provider compensation are explained during the plan design process, so you understand how the program works before moving forward.
